General Terms, Conditions and Privacy Policy of PulseGymShop.bg

This document contains the General Terms of Use of the PulseGymShop.bg Site. Unpleasant, but if you do not agree with the Terms and Conditions, there is no possibility to use the PulseGymShop.bg site and to enter into contracts with ANA Pro EOOD . Upon a change in the Policy, the changes will be posted here.

1.1. Please be aware of these General Terms and Conditions before accessing the Site and signing distance sale contract with us.

1.2. Please be aware that you agree to comply with all of these terms and conditions when using PulseGymShop.bg. Unpleasant, but if you do not agree with the General Terms and Conditions, there is no possibility to use the Site.

III. DEFINITIONS:

3.1. Customer – any natural or legal person or other legal entity that uses PulseGymShop.bg to conclude distance and delivery contracts.

3.2. User – any natural or legal person or other legal entity that uses PulseGymShop.bg in any way, including by browsing in it.

3.3. Profile – a section from PulseGymShop.bg, formed by an email address and a password that allows customers to enter into a distance sales and delivery contract with us, without the need to specify a delivery address for each order, to see the history of his/her purchases, bonus points, claims or disputes, transactions, etc. 

3.4. Service – acquainting with the products offered by ANA Pro EOOD  and concluding and executing the distance and delivery contract for the ordered goods.

3.5. Order – signing of a distance-purchase contract.

IV. GENERAL

4.1. General Terms of ANA Pro EOOD  are obligatory for all customers and users of the site – PulseGymShop.bg.

4.2. Any use of the site – PulseGymShop.bg means that you have become acquainted with the General Terms of use and have agreed to abide by them unconditionally.

4.3. The General Terms may be changed unilaterally by ANA Pro EOOD  at any time. This may be due to a company's own decision or may be required by virtue of a statutory instrument. These changes take effect immediately and are binding on all customers and users.

4.4. In any case of changing the General Terms and Conditions, ANA Pro EOOD  will inform its customers and users by publishing the changes in the website – PulseGymShop.bg, which is why we inform you that you have the obligation to consult for any changes to the General Terms and Conditions – PulseGymShop.bg at any time.

4.5. If any provision of these General Terms and Conditions for use of the website is found to be invalid or unenforceable irrespective of the reason for this, this does not affect the invalidity or inapplicability of other provisions.

4.6. ANA Pro EOOD  makes serious efforts to maintain the accuracy of the information presented on the PulseGymShop.bg website, however, given the possible technical errors or omissions in this information, ANA Pro EOOD specifies that the images of the products have an illustrative and guiding character, respectively the products delivered may differ from the images.

4.7. The features or prices of the products described on the website may be changed at any time. Due to technical reasons, they may contain errors for which ANA Pro EOOD  apologizes to its customers and users and asks them to immediately inform us through the contact form.

4.8. Product descriptions are sometimes incomplete due to the limited space on the web page.

4.9. All products, including promotion/discount items, are sold and delivered until the stocks are exhausted even if it is not explicitly marked on the site – PulseGymShop.bg.

4.10. PulseGymShop.bg contains links to other websites. ANA Pro EOOD  is not responsible for the Privacy policy of websites it does not administer as well as for any other information contained therein.

V. SIGNING A CONTRACT

5.1. The Customer declares his willingness to enter into a distance purchase contract with Us and to buy a product offered by Us through the website - PulseGymShop.bg by making an Order electronically.

5.2. To this end, after choosing the product(s) he/she wishes to buy, as well as the quantity and specifications of the same, he/she should click on "Add". After selecting all the products that the customer wants to buy, he/she should click on "Basket". Here you can enter a discount code or gift voucher if you have one, then enter in a few successive steps the details of the delivery method and address, payment method, and click on "Confirm Order".

5.3. ANA Pro EOOD  has the right not to deliver part or all of the Products of the Order for various objective reasons, including but not limited to the exhaustion of their stock availability. In this case, Seller's sole responsibility is to return any price previously received for the Products.

5.4. In order not to fill in the data under p.5.2.every time you want to purchase it is highly recommended that you create a Profile. Use the "Sign up" button to create an account by entering your personal details in the registration form.

5.5. ANA Pro EOOD  identifies the users of the site by storing log files on the server of PulseGymShop.bg and the Buyer's IP address. ANA Pro EOOD  has the right to collect and use information about the Users after their identification. The information by which the person can be identified may include name, surname, date of birth, gender, address, telephone, and any other information that the person provides voluntarily upon identification. The information includes any other information that the User enters, uses or provides upon the use of the Services / Goods that the company provides.

5.6. Once you've set up your account, you'll be able to see your purchase history, bonus points, claim requests, transactions, and more.

5.7. By placing an order through the website, you ensure that you are legally in a position to enter into binding contracts.

5.8. The distance-purchase contract between the Seller and the Customer is deemed to have been concluded at the time of receipt by the Customer of a notice that the Goods from the Order are ready for dispatch.

5.9. The purchase contract concluded between the Customer and the Seller consists of the present General Terms and Conditions and any possible additional agreements between the Seller and the Buyer. Each contract may be accompanied by a warranty certificate issued by the Seller or its supplier for the Goods purchased if available for such goods.

VI. ONLINE SALES POLICY

6.1. Access to PulseGymShop.bg for the purpose of concluding a distance-purchase contract is allowed to each client. The online store contains goods intended for adult customers only.

6.2. ANA Pro EOOD reserves the right in its sole discretion to limit the access of any customer or user to the conclusion of a Contract if it considers that this would be to the detriment of ANA Pro EOOD in any way. Therefore, the sole right of the customer or the user is to fill in the contact form with Us in order to be informed of the reasons which have led to the implementation of the above-mentioned measures. ANA Pro EOOD  is not responsible for any damages that the client or the consumer has suffered or may suffer as a result of this decision, regardless of its correctness or justifiability.

6.3. The Customer has the right to publish opinions on the products offered on the Site, as well as to contact us through the contact form. Posts or messages that contain obscene words or inappropriate vocabularies will be removed from the Site or ignored.

6.4. Communication with the Seller may be accomplished by direct communication through the contact form.

6.5. ANA Pro EOOD  may publish advertising or promotional information for the Goods on the Site for a certain period of time.

6.7. All prices of the Goods on the site - PulseGymShop.bg, are final, are declared in BGN (BGN) including VAT and all other taxes or fees required by law.

6.8. The payment of the Goods is usually made with cash on delivery of the Goods.

6.9. In the case of agreed online payments or bank payments ANA Pro EOOD does not bear any liability for any expenses in connection with fees, commissions or other additional payments made by the customer or his bank on the occasion of the transaction itself, as well as in the case of exchange of currency, applied by the bank issuing the card to the client in cases where the currency is different from BGN. Card payment to ANA Pro EOOD  is considered as an international payment by the banks in Bulgaria and according to their rules for handling cards and card payments in this type of transaction some banks charge additional fees. The costs associated with such payments are solely for the account of the client. Therefore, ANA Pro EOOD  recommends to its clients to consult with their bank about possible additional fees that could be charged to them on online payments or through a bank for Products sold by ANA Pro EOOD .

6.10. The customer or the user is obliged to provide all the necessary information for issuing the invoice in accordance with the Bulgarian legislation in force, on the basis of which an invoice will be issued for the goods ordered and delivered.

6.11. Some offers are tied to a maximum quantity that can be purchased by one customer. If applicable, this is detailed in the individual proposal.

6.12. If ANA Pro EOOD  cannot fulfill the Order once you have paid the price, you will refund the amount paid to you on a specified bank account.

6.13. ANA Pro EOOD  has the right to use subcontractors for the fulfillment of their obligations under the distance-purchase contract concluded through the PulseGymShop.bg website, without the need to notify or obtain the client's consent for this. The corresponding ANA Pro EOOD  will be responsible for the actions of these subcontractors as their own.

VII. ORDER. CANCELING A ORDER. REFUSAL OF ORDER.

7.1. The Customer or the User undertakes and is responsible for ensuring that all data that he has provided to ANA Pro EOOD  in connection with the Order are correct, complete and accurate as of the date of sending the order.

7.2. By sending the order, the customer or the user authorizes ANA Pro EOOD to contact him in any possible way when this is necessary in connection with the order made.

7.3. ANA Pro EOOD has the right to refuse to execute (cancel) the Order made. Cancellation of the order does not entail any liability or consequent obligation of ANA Pro EOOD to the client or the user in relation to it and the latter has no right to seek compensation from the other party for its cancellation in the following cases:

• non-acceptance by the issuing bank of the customer or the user of the online payment transaction;

• the realization of the monetary transaction, which does not lead to the receipt of funds to the account of ANA Pro EOOD  for online payments

• provided by the customer or the user data on the Site are incomplete and/or incorrect.

7.4. The Customer / User has the right to withdraw from the contract concluded online without giving any reason without due compensation or penalty within 14 days from the date of acceptance of the goods by the User or a third party. The customer or user is obliged to pay all direct costs for the return of products offered by ANA Pro EOOD in case he cancels the contract within 14 (fourteen) days from the date of receipt of the product and declares this within the term for refusal. This period begins to run from the date of receipt of the purchased Goods by the customer or user or third parties other than the carrier. The Customer or the User should return the Product to  Sofia, p.k. 1618 Vitosha district bul./ ul. "Bulgaria" № 132, ent. A, and in the meantime informed ANA Pro EOOD  about this through the contact form of the Site. Courier services to return the Goods are at the expense of the customer or the user.

7.5 ANA Pro EOOD  is obliged to refund the paid price on the Order within one month from the return of the product(s) from which the customer or the consumer has declined. The amount will be refunded after the customer or user has provided his bank account.

7.6. ANA Pro EOOD  undertakes to publish in its General Terms a form for exercising the right of withdrawal from the contract.

7.7. For exercising the right of withdrawal ANA Pro EOOD offers the consumer the opportunity to choose to fill in and send electronically through the website the standard rejection/claim form or other unambiguous application.

7.8. The consumer/buyer is obliged to return the product as it has received it, with the whole package, the receipt, and the invoice when issued.

VIII. GOODS FOR WHICH THE CUSTOMER OR USER HAS NO RIGHT OF REFUSAL

8.1. The order can not be canceled in the following cases:

• in the case of delivery of goods made to the Customer or according to its individual requirements.
• in the case of a supply of goods which, by their nature, may deteriorate or have a short shelf life.
• upon delivery of sealed goods that have been printed after delivery and can not be returned for reasons of hygiene or health protection.
• in the case of the supply of goods which, having been supplied and by reason of their nature, have been mixed with other goods from which they can not be separated.

IX. EMAIL SUBSCRIPTION

9.1. The website allows you to subscribe and receive notifications of new or up-to-date products at your email address.

9.2. Subscription may be terminated at any time by sending a request to that effect via the contact form.

X. DELIVERY

10.1. ANA Pro EOOD  undertakes to deliver the ordered and purchased Goods through a courier company to an address specified by the customer or the user or in the office of the courier company "Leo Express" or similar company, depending on the choice of the customer or the consumer.

10.2. ANA Pro EOOD  will ensure the appropriate packaging of the Goods and the sending of the accompanying documents. If by any chance the shipment does not contain a document required for the product ordered, please contact us through our contact form and we will do our best to provide you with the fastest possible delivery.

10.3. ANA Pro EOOD  will deliver the goods only on the territory of Bulgaria. If more than one address is stored in the profile, the delivery will be sent to the one that was specified when the order was made.

XI. TRANSFER OF OWN GOODS

11.1. The ownership of the Goods will be transferred from ANA Pro EOOD to the delivery to the customer or the consumer after the payment has been made by him. The delivery of the Goods will be certified by the signature of the customer or the user of the transport document provided by the courier.

XII. POST A COMMENT, QUESTIONS, AND CLAIMS.

12.1. Writing Comments on the site - PulseGymShop.bg is done through an integrated Facebook - comment system, so before you write a comment you should read the General Terms and Policies of the specified social network. ANA Pro EOOD  has no control over these integrated external systems.

12.2. Comments should observe the ethical and moral requirements and be in a good tone.

12.3. If any Comment has unacceptable content, it may be removed from ANA Pro EOOD .

12.4. If ANA Pro EOOD  finds a repeated breach of the present conditions for writing comments, the same reserves the right to restrict the ability of the client or the user to publish Comments.

12.5. Inquiries can be made to the address, e-mail address, telephone or via the contact form provided on this site.

12.6. The consumer is entitled to a claim for any non-compliance of the goods with the agreed/ordered when inconsistencies with the sales contract have been found after the delivery.

12.7. The consumer has the right to claim the goods regardless of whether the manufacturer or the trader has provided a commercial guarantee of the good or service.

12.8. When the satisfaction of the claim is made by replacing the goods with another corresponding to the agreed, ANA Pro EOOD  will retain the original warranty conditions.

12.9. Upon claiming the goods, the consumer may claim reimbursement of the amount paid, to replace the goods with another, corresponding to the agreed or withdrawal from the price.

12.10. The complaint is submitted orally to the telephone number specified by ANA Pro EOOD , either in writing or by e-mail, by post or by the address of the company. ANA Pro EOOD presents on its website access to a claim form.

12.11. When a claim is made, the user indicates the subject matter of the claim, the preferred way of claiming, or the amount claimed, and the address, telephone number, and contact email.

12.12. When making a claim, the user must also attach the documents on which the claim is based, namely:

• receipt or invoice;
• protocols, acts or other documents establishing the non-conformity of the good or service with the agreed;
• other documents establishing the claim on grounds and size.

12.13. The consumer product may be reclaimed within two years of delivery of the goods, but not later than two months after the discovery of the non-conformity with the agreed upon and after the expiry and the expiry date.

12.14. The term stops running for the time it takes for an agreement between the seller and the consumer to resolve the dispute.

12.15. If ANA Pro EOOD has provided a commercial guarantee for the good and the term of the guarantee is longer than the time limits for submitting the claim under para. 1, the claim may be claimed until the expiry of the commercial guarantee.

12.16. Placing a claim is not an obstacle to claiming.

12.17. Claims may be made through the form provided for this purpose on the Site: Form for the return of an order or by e-mail address / postal address in free text or by the form enclosed with these General Terms.

12.18. ANA Pro EOOD maintains a register of complaints. A document is sent to the User at the specified email, indicating the number of the claim from the register and the type of the goods.

(2) When ANA Pro EOOD satisfies the claim, it issues an act for this, which is drawn up in duplicate and provides obligatorily one copy to the User.

12.19. ANA Pro EOOD, upon a well-founded claim, brings the goods in compliance with the sales contract within one month from the submission of the claim by the User.

12.20. If the goods have not been repaired after the expiration of the term under the preceding paragraph, the consumer has the right to cancel the contract and to be reimbursed the amount paid or to demand reduction of the price of the consumer goods according to Art. 114 of the CPA.

12.21. Aligning consumer goods in accordance with the sales contract is free to the User. He does not owe any cost to dispose of consumer goods or materials and labor related to the repair and does not suffer any significant inconvenience.

12.22. In the event of non-compliance of the consumer goods with the sales contract and when the consumer is not satisfied with the resolution of the claim, he has the right to choose between one of the following options:

1. termination of the contract and refund of the amount paid by him/her;

2. Price Reduction.

12.23. The consumer can not claim reimbursement of the amount paid or to reduce the price of the goods when the trader agrees to replace the consumer goods with a new one or to repair the goods within one month of the claim being made by the consumer.

12.24. The trader is required to settle a claim for cancellation of the contract and to recover the amount paid by the consumer when, after having satisfied three complaints to the consumer by repairing the same product within the warranty period, there is a subsequent non-compliance of the goods with the contract of sale.

12.25. The consumer can not claim to terminate the contract if the nonconformity of the consumer product with the contract is insignificant.

XIII. RESPONSIBILITY

13.1 ANA Pro EOOD is not responsible for any damages suffered by the customer or user as a result of force majeure or those outside the control of the company.

XIV. PROCESSING OF PERSONAL DATA

14.1. In the processing of personal data, ANA Pro EOOD complies with all applicable to its activity legal acts on the protection of personal data, including but not limited to Regulation (EC) 2016/679 (the "Regulation") and the Personal Data Protection Act , because for us the security of the personal data of our employees, customers and users is of great importance.

14.2. Personal data relating to users or customers and contained in the ANA Pro EOOD database may not be disclosed to third parties except with the express consent of the user or the customer and/or the Bulgarian laws.

14.3. ANA Pro EOOD processes the personal data of its customers and users according to "PULSE GymShop.bg PERSONAL DATA SECURITY POLICY", published on the company's website and/or available in the commercial sites.

XV. APPLICABLE LAW. DISPUTES

15.1. Disputes arising between ANA Pro EOOD and a customer or user will be resolved by mutual consent or, if that is not possible, disputes will be settled in accordance with Bulgarian law by the competent court in Sofia.

15.2. Users can use the European Dispute Resolution Online Platform (ODR) available at http://ec.europa.eu/odr/ - a single access portal that allows EU users and traders to settle disputes between themselves.

Privacy Policy for Individuals

Of great importance to ANA Pro EOOD is your personal integrity. In this regard, this Privacy Policy is intended to disclose what personal data we collect for you through our joint relationships and how we use this data. For the purpose of concluding and executing the contract for distance and delivery of the ordered goods through the website PulseGymShop.bg ("Site"), ANA Pro EOOD ("We"), UIC: 201376534 with headquarters and management address:  Sofia, p.k. 1618 Vitosha district bul./ ul. "Bulgaria" № 132, ent. A, process data of individuals ("Data subjects" / "You" ") in accordance with this Policy.

ANA Pro EOOD is a data controller with regard to the information gathered during the examination of the Site and the purchase of the products we offer. With the processing of personal data, ANA Pro EOOD complies with all applicable to its activity normative acts on the protection of personal including but not limited to Regulation (EC) 2016/679 (the "Regulation") and the Personal Data Protection Act, because for us the personal data security of our employees, clients, partners and users of PulseGymShop.bg e of paramount importance.

According to the Regulation, personal data is any information that relates to you and through which you can be identified or have already been identified.

Processing of personal data ("Processing") is any action or set of actions that can be performed on personal data by automatic or other means.

II.  Personal data we process:

It is not possible to provide the Services on the Site and to conclude and execute a contract with you if you do not provide us with any information. In this regard, we require certain information from you. You decide whether and how to use the Services provided through the Site. The forms through which personal data are entered clearly indicate the mandatory or voluntary nature of data provision. The data, which must be filled in, are such that it is impossible to conclude and execute the respective contract. These are quite simple things like:
